Introduction

These terms and conditions set forth the contractual framework for services offered by EasyJetCompensation, a platform that connects customers with our certified service partners specializing in air travel claims.

Agreement

By signing the authorization document, the customer agrees to these terms and conditions.

An agreement is formed when EasyJetCompensation accepts to facilitate the processing of the customer’s claim through our partner network. EasyJetCompensation reserves the right to decline the facilitation of any claim at its discretion. In such cases, EasyJetCompensation will notify the customer.

By agreeing to these terms, the customer confirms their authorization and capacity to enter into this agreement.

The customer warrants that the claim has not been assigned or sold to any third party, and that no legal disputes related to the claim are pending or expected. Once the authorization document is signed, the customer agrees not to engage other parties to handle the claim. Any existing assignments or related agreements must be terminated prior to the signing of the authorization document.

Should the customer receive direct payment or other compensation from the airline after the authorization document is formalized, they must immediately notify EasyJetCompensation. Such payments are considered compensation for the flight incident. After the authorization document is signed, the customer is obliged to halt any direct negotiations with the airline and direct all communications through EasyJetCompensation to ensure the most favorable outcome.

The contract concludes:

When EasyJetCompensation confirms that compensation has been successfully negotiated by our partners and received from the airline, and then transferred to the customer after deducting any applicable fees.

When EasyJetCompensation, after evaluating the claim’s feasibility, advises the customer that it is impractical to proceed with the claim.

This version highlights your role as a mediator and ensures it’s clear that your service involves directing customers to partners who handle the claims process, rather than engaging in legal actions directly.

Description of the Service

EasyJetCompensation connects customers with certified service providers who specialize in handling both non-legal and legal claims to secure financial compensation under the regulations governing air transport of passengers and baggage.

Customers are required to submit their flight data and relevant information through the EasyJetCompensation website, email, telephone, or other compatible electronic means. Upon receiving a request, EasyJetCompensation assesses the viability of the claim and, if appropriate, forwards it to a partner service provider.

For the claim to proceed effectively, EasyJetCompensation requires customers to complete and submit an authorization document, which can be done via the website, email, or postal service. Once the authorization is confirmed, EasyJetCompensation promptly directs the claim to the appropriate partner, who will manage the entire resolution process.

Our partners strive to negotiate a satisfactory resolution for the customer. If the airline does not respond within a reasonable time or if their response is unsatisfactory, our partner may escalate the claim for legal review, depending on the agreement with the customer. In such cases, the customer consents to providing all necessary documentation and agrees to any legal actions recommended by the partnered service provider. EasyJetCompensation and its partners ensure transparency and keep the customer informed throughout the process.

If additional legal documentation is necessary, such as affidavits or transfer of rights, the customer is responsible for signing and, if required, covering the costs of these documents. The partner will not proceed with a claim if they determine there is little chance of success, ensuring resources are used efficiently.

If the claim is successful or a settlement is reached, the agreed upon fees will be charged by the service provider, not by EasyJetCompensation.

This version should more accurately reflect your business model as a mediator between customers and service providers, avoiding any implication of direct legal representation or claims handling.

Fee and Commission

EasyJetCompensation facilitates the connection of customers with service providers at no initial cost to the customer. If compensation is successfully obtained through our partners, a commission based on a percentage of the amount recovered will be deducted as our fee. Customers are also responsible for informing EasyJetCompensation if they receive any compensation directly from the airline or legal proceedings, and comply with the agreed fee structure.

Should a customer fail to disclose compensation received directly, and if EasyJetCompensation has initiated the claim process, the previously agreed upon commission will be charged. If a claim is withdrawn at the customer’s request, due to duplicate claims, non-attendance at necessary proceedings, or negligence, fees related to the services already rendered by our partners will be due up to the point of claim withdrawal.

The legal process managed by our partners is considered initiated once the claim is formally filed. In scenarios where hearings are required by the air carrier or the judiciary, the customer is expected to either attend or provide appropriate legal authorization for representation. Should the customer be unable to attend, representation may be arranged through our partners, with any costs covered by the customer.

In the event of a favorable judgment including procedural fees and interest, the customer authorizes our partners to manage these funds. Conversely, if the claim is unsuccessful, the customer will not be responsible for any additional costs incurred during the process.

Customers are obligated to provide accurate and complete information necessary for receiving compensation. Failure to provide such information may result in additional costs, which EasyJetCompensation reserves the right to deduct from the compensation amount. Persistent failure to respond to requests for necessary information may lead EasyJetCompensation to withhold the respective portion of the compensation.

From the point of compensation disbursement by the airline or court, EasyJetCompensation is not responsible for payment errors caused by incorrect customer information, nor will it pursue recovery of funds mistakenly sent to incorrect recipients. EasyJetCompensation is also not liable for any delays in payment transfer due to external factors beyond its control, such as natural disasters, legal restrictions, or labor disputes.

Data Protection

EasyJetCompensation is committed to protecting and processing the personal data provided by customers solely for the purpose of facilitating their claims, in strict compliance with EU data protection regulations, notably the General Data Protection Regulation (GDPR) 2016/679. Customers explicitly authorize EasyJetCompensation to use their data within the scope of these activities. Personal data will only be shared with third parties under the following circumstances:

  • When it is necessary for the original purpose for which the data was collected.
  • For the preparation, negotiation, and execution of contracts with the client.
  • When required by legal, administrative, or judicial directives.
  • If needed to verify or protect rights in judicial proceedings.

Customer Information and Data

Customers are required to provide all necessary and accurate information for the effective management of their claims. Customers must ensure that all provided data is correct, complete, and truthful. Customers also agree to hold EasyJetCompensation harmless against any third-party claims arising from incorrect or fraudulent communication of data.

Should there be any discrepancies in the data provided or any instances of fraudulent behavior, EasyJetCompensation reserves the right to immediately terminate the agreement. If the contract is terminated under these conditions, the customer will forfeit any right to compensation. All documentation related to the handling of the claim remains the property of EasyJetCompensation, although access will be provided to the customer upon request. EasyJetCompensation will keep the customer regularly informed about the status of their claim.

Withdrawal Policy

Customers are granted a 14-day period from the date of agreement to exercise their right to withdraw from the contract without incurring any costs. To initiate a withdrawal, customers must provide a clear declaration of their intent to cancel the claim via email to [email protected]. Withdrawal is not permitted once the claim has been accepted by the service provider, as this signifies the completion of the requested service.

Final Provisions

EasyJetCompensation reserves the right to amend these Terms and Conditions, fee structures, and any additional terms at any time without prior notification. Any changes that adversely affect clients will only be applied with explicit client consent. These Terms and Conditions, along with the authorization document and any agreements, are governed by applicable laws. Disputes arising under these terms will be resolved through judicial proceedings. Should any part of these Terms and Conditions be found void, illegal, or unenforceable, the validity of the remaining provisions will not be affected.
